These terms govern your use of FreshProbate, a sole proprietorship based in Texas ("FreshProbate," "we," "us"). By requesting a sample, subscribing or paying for a list, you agree to them.
FreshProbate compiles weekly lists of newly filed Harris County, Texas probate cases matched to property records, delivered electronically. Lists are built from public records, mainly Harris County Clerk court filings and the Harris Central Appraisal District (HCAD) property roll. FreshProbate is not affiliated with Harris County, the County Clerk or HCAD.
You can cancel anytime by emailing hello@freshprobate.com or through any billing link we provide. Cancellation stops future charges; you keep access to every list already delivered. Because each list is a digital product delivered immediately, payments for lists already delivered are not refundable. If a scheduled list is not delivered, tell us and we will deliver it or refund that week.
Each list is licensed to the subscribing person or business for its own internal business use, such as marketing to property owners or researching acquisitions. You may share lists with your own employees and contractors working on your business. You may not resell, republish, sublicense or redistribute the lists or any substantial part of them, in any form, without our written permission.
Public records can be incomplete, late or wrong, and matching court cases to property records involves judgment. Confidence grades and notes are our best estimate, not a guarantee. Lists are provided "as is," without warranties of any kind, express or implied, including accuracy, completeness, merchantability or fitness for a particular purpose. Verify information independently before relying on it. Nothing we provide is legal, tax, financial or real estate advice.
FreshProbate does not contact anyone on your behalf and does not provide phone numbers. You are solely responsible for how you use the lists and for complying with every law that applies to your marketing and transactions, including the Telephone Consumer Protection Act, the CAN-SPAM Act, do-not-call rules, Texas telemarketing and solicitation laws, fair housing laws and any licensing requirements. People in these records are often grieving; you agree not to use the lists to harass, mislead or pressure anyone.
To the fullest extent allowed by law, FreshProbate will not be liable for any indirect, incidental, special, consequential or lost-profit damages arising from the service or the lists. Our total liability for any claim is limited to the amount you paid us in the 30 days before the claim arose.
You agree to defend and hold FreshProbate harmless from claims, fines and costs arising from your use of the lists or your violation of these terms or any law.
We may suspend or end access for nonpayment, misuse of the lists, or violation of these terms.
We may update these terms. The effective date at the top shows the latest version, and continued use after a change means you accept it. Material changes will be emailed to active subscribers.
These terms are governed by the laws of the State of Texas. Any dispute will be resolved in the state courts located in McLennan County, Texas.
